Administrative Measures for the Review of Mayor's Quality Award of Guangzhou

Chapter 1 General Provisions

  Article 1 In light of the realities of Guangzhou, the Measures are formulated according to the Law of the People's Republic of China on Product Quality and the Guiding Opinions of the CPC Central Committee and the State Council on Launching Quality Improvement Actions and taking into account the relevant provisions of the Measures for the Administration of the China Quality Award and the Measures of the Guangdong Provincial Government for the Administration of Quality Awards (YFB [2021] No. 55). The Measures aim to establish sound government-based quality incentive systems, standardize the review process for the Mayor's Quality Award, set role models of quality, foster quality-driven development, build Guangzhou into a city recognized for excellence in quality, and boost the city's independent innovation capabilities and comprehensive competitiveness.

  Article 2 For the purpose of the Measures, the Mayor's Quality Award of Guangzhou (hereinafter referred to as the Mayor's Quality Award) is the highest quality award established by the Guangzhou Municipal People's Government to commend organizations and individuals who have made outstanding achievements in creating advanced quality management models, promoting advanced quality concepts, practicing well-designed quality management approaches, setting exemplary role models, and contributing to building Guangzhou into a city recognized for excellence in quality.

  Article 3 The Mayor’s Quality Award is a certification aiming to distinguish top-tier quality models by selecting the best among the good. The evaluation and review process adheres to principles of rationality, impartiality, fairness, and transparency. No fees are charged for applicants. The review is conducted in strict accordance with evaluation standards and procedures, predicated on the applicant's voluntary submission.

  Article 4 The Mayor's Quality Award is reviewed every two years, including the Mayor's Quality Award and the Mayor's Quality Award Nomination.

  During each session, both the Mayor's Quality Award and the Mayor's Quality Award Nomination are bestowed upon a maximum of five organizations and individuals. The award may remain unassigned if there are no eligible candidates.

  Article 5 The Mayor's Quality Award Review Committee (hereinafter referred to as the "Review Committee") and the Secretariat are set up to take charge of the review.

  Article 6 The Mayor's Quality Award is reviewed based on the Criteria for Performance Excellence (GB/T19580) and Guidelines for the Criteria of Performance Excellence (GB/Z19579)while taking into account international and domestic advanced quality management evaluation standards. It will be subject to adjustments to reflect developments in practice.

Chapter 2 Organizational Management

  Article 7 The Review Committee is structured as follows:

  Director: The Deputy Mayor in charge;

  Deputy Directors: The Deputy Secretary-General of the General Affairs Office of the Guangzhou Municipal People's Government; Key leaders from the Guangzhou Municipal Administration for Market Regulation.

  Members: Heads of the following municipal departments and authorities: Development and Reform; Education; Science and Technology; Industry and Information Technology; Public Security; Human Resources and Social Security; Ecological Environment; Housing and Urban-Rural Development; Transport; Water Supplies; Agriculture and Rural Affairs; Commerce; Culture, Radio, Television and Tourism; Health; Emergency Management; State-Owned Assets Supervision and Administration; Market Regulation; Statistics; Financial Regulation; Tax Service; Customs; Other relevant municipal government authorities. 

  Article 8 The Review Committee is mainly responsible for:

  (I) Organizing and coordinating the review activities, deciding and handling major issues in the review process;

  (II) Deliberating the rules of procedure of the Review Committee, the working rules of the Secretariat of the Review Committee, the regulations on the management of reviewers, and other work rules;

  (III) Deliberating the review results, listing organizations and individuals to be awarded, and submitting the list to the Guangzhou Municipal People's Government for approval;

  (IV) Coordinating other major issues in the review process.

  Article 9 The Secretariat (located in the Guangzhou Municipal Administration for Market Regulation) is responsible for organizing and coordinating the routine management of the review activities. The staffing, working rules, and rules of procedure of the Secretariat are reviewed and published by the Review Committee.

  Article 10 The Secretariat of the Review Committee is mainly responsible for:

  (I) Organizing, promoting, and guiding the review activities;

  (II) Organizing the formulation (revision) of the Administrative Measures for the Review of Mayor's Quality Award of Guangzhou and supporting rules;

  (III) Selecting review experts from the pool of quality award review experts of the Guangdong Provincial Government following the principle of "Double Randomization";

  (IV) Reporting the review work to the Review Committee, and submitting the proposed list of recipients to the Review Committee for approval;

  (V) Organizing the promotion of advanced quality management approaches, technologies and application results, and regulating and overseeing the use of Mayor's Quality Award honors and logos;

  (VI) Completing other tasks assigned by the Review Committee.

  Article 11 The municipal government departments responsible for development and reform, education, industry and information technology, ecological environment, housing and urban-rural development, commerce, culture, radio, television and tourism, health, market regulation and financial regulation, among others, as well as district-level people's governments, and all industry associations of Guangzhou are tasked with creating quality awards within their respective systems, jurisdictions, and industries. Additionally, they are responsible for actively engaging and encouraging both organizations and individuals to apply for these awards.

Chapter 3 Requirements for Applicants

  Article 12 All organizations applying for the Mayor's Quality Award must:

  (I) Conduct its production and operational activities within Guangzhou, with its primary business in normal operation for more than five years;

  (II) Uphold the Party's and national routes, principles and policies, meet the requirements of national, provincial and municipal laws, regulations and policies on industry, environmental protection, quality, medical care, and education, and have relevant qualifications or licenses;

  (III) Be equipped with a sound quality management organization and a well-established quality management system, with their quality management systems, models and practices worth promotion;

  (IV) Embrace the development philosophy that emphasizes "quality first and prioritizes performance," promote a culture that celebrates exceptional quality, drive significant quality improvements, and lead the industry in terms of quality standards, innovation capabilities, brand influence, and economic and social contributions;

  (V) Actively fulfill social responsibilities, without any major quality, safety or environmental protection accidents or any records of violations of laws, regulations or disciplines in the past three years.

  Article 13 All individuals applying for the Mayor's Quality Award must:

  (I) Uphold the Party's and national routes, principles and policies, observe professional ethics and social public order and good morals, without any records of violations of laws, regulations or disciplines;

  (II) Have at least five years of experience in quality-related work and at least two years of experience in quality-related work in the administrative regions of Guangzhou;

  (III) Be hungry for quality innovation, entrench the concept of high-quality development, give great impetus to quality reform, actively promote advanced quality management models, approaches and best practices, and make great contributions to promoting quality management.

Chapter 4 Review Procedure

  Article 14 The review activities are carried out according to the following procedures:

  (I) Application. Organizations and individuals applying for the Award (hereinafter collectively referred to as the "applicant") fill out the application form truthfully on a voluntary basis in accordance with the review plan and requirements issued by the Secretariat. After an internal public evaluation for five working days, the completed forms are submitted to the market regulatory authority of the district where the applicants are located.

  (II) Referral. The district-level market regulatory authority conduct preliminary examinations of the applicant's qualifications and the completeness of application materials in collaboration with members of the district-level leading group for developing a strong district on quality and the district-level administrative authorities of relevant industries, publicize the list of applicants to the public for five working days, list eligible referees, and forward the list approved by the district-level leading group to the Secretariat.

  (III) Qualification Review. The Secretariat reviews the applicant's qualifications and the completeness of application materials, consult with members of the Guangzhou Municipal Leading Group for Developing a City Recognized for Excellence in Quality and the municipal administrative authorities of relevant industries, and publicize the list of eligible applicants and main information in the application forms to the public for five working days.

  (IV) Information Review. Selected review experts, organized by the Secretariat in line with the "Double Randomization" principles, evaluate the applications, score them, provide review comments, and propose candidate lists for both the Mayor's Quality Award and the Nomination. The lists are then submitted to the Review Committee for deliberation.

  (V) Shortlist. The Review Committee deliberates about the qualification and information review results and create shortlists for the Mayor's Quality Award and the Nomination, based on the scores and the Secretariat’s input.

  (VI) On-site Review. A panel of review experts is established by the Secretariat to conduct on-site evaluations of the shortlisted organizations’ quality management practices. The panel will provide evaluative feedback and assign scores based on their assessments.

  (VII) Statement of Defense. The Secretariat establishes a panel of review experts to assess the defense presentations given by the representatives of organizational nominees and individual candidates for the Mayor's Quality Award. This panel will evaluate their quality management philosophies, specific strategies, and principal accomplishments, culminating in the provision of assessments and scores.

  (VIII) Proposed List. The Secretariat, based on results of previous reviews , prepares a comprehensive report and final scores for the proposed candidates of the Mayor's Quality Award and the Nomination. The report and scores are submitted to the Review Committee for collective deliberation. The Review Committee decide on the proposed awardees of the Mayor's Quality Award and the Nomination based on the final scores and voting results.

  (IX) Announcement and Submission for Approval. The Secretariat announces the proposed awardees to the public for a period of five working days. Assuming no objections, the list is submitted to the Guangzhou Municipal People's Government for approval and the approved list will be published afterward.

  Article 15 Any organization or individual who has any objection to the applicant's qualifications during the review shall raise objections in writing to the Secretariat and submit relevant supporting evidence.

  Article 16 Upon receiving any objections and supporting evidence, the Secretariat must send these documents to the market regulatory authority of the district where the applicant is based within three working days for further assessment. The said district-level market regulatory authority shall respond to the Secretariat in writing, detailing the review outcomes, within three working days. Following a collaborative deliberation, the Secretariat will make a decision regarding the objection, communicate the decision in writing to the individual or organization who raised the objection and notify their referrers.

  The applicant who is the subject of an objection will remain eligible for consideration in the Mayor's Quality Award review process while the objection is being assessed. Should the objection be substantiated and found to contravene the eligibility criteria for the award, the applicant in question will be disqualified from the review process.

Chapter 5 Subsidies and Funding

  Article 17 Organizations and individuals who have received the Mayor's Quality Award must wait for two sessions before they can reapply. However, those who have been nominated for the Mayor's Quality Award are eligible to apply in subsequent sessions without restriction.

  Article 18 The Guangzhou Municipal People's Government publishes the recipients of the Mayor's Quality Award and the nominees and issues medals and certificates to them.

  Article 19 The Guangzhou Municipal People's Government will offer subsidies to organizations and individuals who have received the Mayor's Quality Award, the Quality Award of the Guangdong Provincial Government, the China Quality Award, and the China Quality Award Nomination. Organizations and individuals who are awarded the same honor for a subsequent time will not be eligible to receive additional subsidies for that repeated recognition.

  Subsidies awarded will be included in Guangzhou's fiscal budget, and the overall funding for the review process will be sourced from the operational funds of the Guangzhou Municipal Administration for Market Regulation. The subsidies allocated for quality-related activities must be used exclusively for the following purposes: to promote advanced quality management models, approaches, and best practices; address critical technical issues related to quality; foster continuous improvement in quality, enhance the skill set of the workforce, and engage in international exchanges and collaborations concerning quality and quality standards. These funds should not be diverted for other purposes.

Chapter 6 Popularization and Application

  Article 20 The Secretariat shall work with various municipal government departments including those responsible for development and reform, education, industry and information technology, housing and urban-rural development, commerce, culture, radio, television and tourism, health, and financial regulation to promote the application of exemplary performance models. This promotion will primarily target sectors such as modern service industries, advanced manufacturing, engineering construction, medical and healthcare services, education, and public services, with the aim of enhancing the quality of products, services, and engineering projects.

  Article 21 The municipal government departments responsible for development and reform, science and technology, industry and information technology, housing and urban-rural development, commerce, and market supervision and administration, among others, shall intensify their support for activities aimed at enhancing quality and fostering innovation, and proactively promote the award recipients' best practices and accomplishments.

  Article 22 All activities related to quality management are advocated, such as basic research, application and promotion, consulting and evaluation, personnel training, and international cooperation.

  Article 23 Award recipients shall actively participate in the popularization programs launched by the Secretariat of the Review Committee and the Office of Guangzhou Municipal Leading Group for Developing a Developing a City Recognized for Excellence in Quality to share their advanced quality management models, approaches, and best practices with the wider community, fulfill their social responsibilities, set exemplary role models, and contribute to the overall improvement of Guangzhou's quality management.

Chapter 7 Supervision and Management

  Article 24 Award recipients are required to submit the Guangzhou Mayor's Quality Award Performance Report to the Secretariat of the Review Committee every December for four years following the award year. Additionally, they are expected to actively participate in the performance statistical surveys conducted by the Office of Guangzhou Municipal Leading Group for Developing a City Recognized for Excellence in Quality.

  Article 25 Staff members and review experts participating in the review of the Mayor's Quality Award must recuse themselves if they have a direct interest in any of the applicant organizations or individuals. Furthermore, they are obliged to maintain confidentiality regarding any sensitive information encountered during the review process.

  Article 26 Staff members and review experts participating in the review of the Mayor's Quality Award must adhere rigorously to ethical guidelines and maintain the highest standards of integrity.

  Staff members found to be committing fraud, engaging in malpractice for personal gain, or neglecting their duties while participating in the review process will face severe penalties in accordance with applicable regulations. Review experts who breach the established review protocols will be disqualified from the current review process. Any instances of legal or disciplinary infractions will be referred to the appropriate authority for punishment in accordance with relevant regulations and made public as dictated by law.

  Article 27 The applicant bears full responsibility for ensuring that the information provided in the application form is authentic, accurate, and complies with all legal requirements. Should the information provided by the applicant be found to be false or in violation of the law, the applicant will be disqualified from the review process and the disqualification will be made public as dictated by law.

  Applicants found to have obtained the Mayor's Quality Award or Nomination through fraudulent means, bribery, or other improper conduct will be disqualified from the review. For those who have already received an award, the Secretariat, upon approval from the Guangzhou Municipal People's Government, will revoke the honor, as well as any associated medals and certificates. Furthermore, all previously granted subsidies will be reclaimed and the revocation will be made public as dictated by law.

  Article 28 All district-level market regulatory authorities shall, in conjunction with the appropriate district-level authorities, conduct follow-up visits to all organizations and individuals within their jurisdictions that have received awards.

  If the award recipients experience major incidents related to quality, safety, environmental protection, or are found to have seriously breached laws, regulations, guidelines, and the Measures within three years post-award, they will be stripped of their title, medal, and certificate. Additionally, any subsidies previously granted will be reclaimed, and the actions taken against them will be made public as dictated by law.

  Article 29 Award recipients must specify the year they received the Mayor's Quality Award when they use this honor for self-promotion. Furthermore, they are prohibited from using the honor or the award logo to advertise products and services or engage in any commercial profit-making activities.

Chapter 8 Supplementary Provisions

  Article 30 All district-level governments in Guangzhou are encouraged and supported to establish their respective quality incentive systems, promoting advanced quality management practices.

  Article 31 The Measures apply to the review and management of the Mayor's Quality Award and will be effective for a five-year period starting from January 1, 2024. The Notice of the General Affairs Office of Guangzhou Municipal People’s Government on Issuing the Administrative Measures for the Review of Mayor's Quality Award of Guangzhou (SFBG [2020] No. 20) shall be repealed simultaneously.
